1. Using our site

You must be at least 18, or have a parent or guardian's permission and involvement, to place an order. You agree to give us accurate, current information and to use the site only for lawful, personal, non-commercial purposes.

You may not misuse the site — for example by attempting to gain unauthorized access, interfering with its operation, scraping or copying content in bulk, placing fraudulent orders, or using it to send spam or harmful code.

2. Your account

When you place an order, we automatically create an account for you using the details you provided, so you can view your order history, track packages and check out faster. You can also create one any time from the “Sign in” page. Accounts are password-free: we email a one-time code and sign-in link to the address on the account.

Because access depends on your email, please keep your email account secure and don't forward sign-in emails. You're responsible for activity in your account. Tell us right away at contact@bwoodsdesigns.com if you think someone else has accessed it. We may suspend or close accounts used in violation of these Terms, and you may ask us to close yours at any time.

3. Personalized & custom items

Most of our pieces are embroidered or laser engraved to order with the monogram, name, text, font, thread color and design you choose.

• Please check your personalization carefully. We stitch or engrave exactly what you enter — including spelling, capitalization, letter order (for traditional monograms: first, last, middle) and punctuation. We aren't responsible for errors in the information you provide.
• On-screen previews are digital approximations. Actual thread and material colors, stitch texture, size and placement can vary slightly because of screen settings, fabric and the handmade nature of our work. These variations are not defects.
• Because each piece is made for you, production begins shortly after you order. Changes or cancellations may not be possible once work has started; contact us as soon as possible at contact@bwoodsdesigns.com.
• By submitting personalization, you confirm that you have the right to use the names, words, initials, symbols and designs you request, and that they don't infringe anyone else's trademark, copyright or other rights. We may decline or cancel (with a full refund) any request we believe is offensive, unlawful, or uses protected marks — such as sports, university, Greek-organization or character logos — without authorization.

4. Orders, pricing & payment

Prices are in U.S. dollars and may change without notice. Limited-time and limited-edition collections are available only while the offer lasts and while supplies last. Promotional codes have the terms stated with them, can't be exchanged for cash, and may be withdrawn at any time.

Your order is an offer to buy. We accept it when we confirm it by email, and we may decline or cancel an order — for example if an item is unavailable, a price or description was displayed in error, or we suspect fraud. If we cancel after you've been charged, we'll refund you in full.

Payments are processed securely by Stripe. We never see or store your full card number. If you choose to save a card, it's stored by Stripe and you can remove it from your account at any time. Applicable sales tax is calculated at checkout.

We try to describe and photograph products accurately, but we don't warrant that descriptions, colors or other content are error-free.

5. Production, shipping & delivery

Production and delivery times are estimates, not guarantees. Personalized pieces are typically made within the time shown on the site before they ship, and transit time depends on the carrier and service you choose. Details are on our Shipping & Returns page.

Please make sure your shipping address is correct. We'll email tracking when your package ships. Risk of loss passes to you when the package is delivered to the address you provided. If a package is lost or arrives damaged, contact us and we'll help with the carrier claim and make it right.

6. Returns, exchanges & refunds

Because personalized items are made just for you, they are final sale and can't be returned or exchanged unless they arrive damaged or with an error on our part. If that happens, contact us within 7 days of delivery with photos, and we'll repair, remake or refund the item.

Unpersonalized items in original, unused condition may be returned within 14 days of delivery for a refund to the original payment method. Full details are on our Shipping & Returns page, which forms part of these Terms.

7. Emails & communications

We send two kinds of email:

• Transactional messages about your orders and account — order confirmations, shipping and tracking updates, sign-in codes and responses to your questions. These are part of the service, so you'll receive them even if you don't subscribe to marketing.
• Marketing emails — new collections, limited drops, events and offers — to our customers and to people who join our list or give us their email. You can say no at checkout by unchecking “Email me”. Every marketing email identifies us, includes our postal address, and has an “Unsubscribe” link. You can opt out any time using that link, from your account's Profile page, or by writing to contact@bwoodsdesigns.com. We process opt-outs promptly — generally right away and always within 10 business days — and we never sell or rent our email list.

We don't currently send text messages. We'll ask for separate consent before we ever do.

8. Reviews, photos & submissions

If you send us reviews, photos, ideas or other content, you confirm it's yours to share and is truthful and lawful, and you give us a non-exclusive, royalty-free, worldwide license to use, display and adapt it (with your first name or initials) on our site, emails and social media. We may moderate or remove content at our discretion. Please don't send confidential information.

9. Intellectual property

The site and its content — including our name, logo, text, photographs, product designs, monogram designs and embroidery and engraving fonts — belong to B. Woods Designs or its licensors and are protected by copyright, trademark and other laws. You may view and share our pages for personal use, but you may not copy, reproduce, sell or create derivative works from them without our written permission. Purchasing an item doesn't transfer any rights in our designs or fonts.

10. Third-party services & links

We rely on trusted providers such as Stripe (payments), shipping carriers and label services, and email delivery services, and the site may link to social media or other sites. Their services are governed by their own terms and privacy policies, and we aren't responsible for third-party sites or content.

11. Disclaimers & limitation of liability

Except as stated in these Terms, the site and our products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the site will be uninterrupted or error-free. Please follow any care instructions provided with your item.

To the fullest extent permitted by law, B. Woods Designs will not be liable for any indirect, incidental, special, consequential or punitive damages, and our total liability for any claim relating to the site or an order is limited to the amount you paid for that order. Some states don't allow certain limitations, so some of these may not apply to you; nothing in these Terms limits rights you have under law that can't be waived.

You agree to indemnify and hold us harmless from claims arising from your misuse of the site, your violation of these Terms, or personalization content you submit that infringes someone else's rights.

12. Governing law & disputes

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. If you have a concern, please contact us first — most issues can be resolved quickly and informally. Any dispute that can't be resolved will be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you and we consent to their jurisdiction, except that either party may bring an eligible claim in small-claims court.

13. Changes & general terms

We may update these Terms from time to time; the date at the top shows the latest version, and changes apply to orders placed after they're posted. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. These Terms, our Privacy Policy and the Shipping & Returns page are the entire agreement between you and us about the site.
